Your use of Supernifty's products, services and software is subject to the terms described on this page.

Exclusion of Warranties

THIS SERVICE IS PROVIDED BY SUPERNIFTY ''AS IS'' AND ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED. IN NO EVENT SHALL SUPERNIFTY OR CONTRIBUTORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THIS SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

Supernifty Acceptable Use Policy

Use of all Supernifty services are subject to this acceptable use policy. Ignorance of this policy (or those that it directs you to), and the responsibilities it places on you, is not an excuse in any situation where it is assessed that you have breached the policy and its requirements.

Conditions

Your use of Supernifty's services must at all times comply with the law.
Your use of Supernifty's services must not interfere with any others' use of these facilities and services.
You must not access any Supernifty program or data which has not been authorised for your use.
You must not use or copy any data or program belonging to other users without their permission.
You must not alter computer material belonging to another user without the users permission.
You must not use Supernifty's services to harass, defame, libel, slander, intimidate, impersonate or otherwise abuse another person.
You must not use Supernifty's services for the creation, collection, storage, downloading or displaying of any offensive, obscene, indecent or menacing images, data or material capable of being resolved into such.
You must not use Supernifty's services to disseminate mass (unsolicited) mailings.

Monitoring and Logging

Activities on the Supernifty site may be monitored and logged. Logs are taken for reasons of security, diagnostic and auditing reasons. Such records and information are sometimes required - under law - by external agencies and authorities. Supernifty will comply with such requests when formally submitted.

Enforcement

Your failure to comply with the AUP may result in suspension or termination, or both, of the Services pursuant to the Agreement.
